This Privacy Policy describes Recoup, and its affiliates, (“Recoup”) collection, use, disclosure, and protection of your information, including your personal information, collected or provided through our website (“Site”) and our mobile application (“App”) and how we use information in connection with our services offered through the Site and App (collectively the “Services”).

By using our Site, App, Services, or otherwise providing us your information, you agree to this Privacy Policy and agree to be bound and abide by our Terms of Service. If you do not agree with any term in this Privacy Policy, please do not provide us your information or use our Site, App, or Services.

Recoup's use of information received from Google APIs will adhere to Google API Services User Data Policy, including the Limited Use and Restricted Use requirements.

We use Plaid Inc. (“Plaid”) to gather End User’s data from financial institutions. By using our service, you grant Recoup and Plaid the right, power, and authority to act on your behalf to access and transmit your personal and financial information from the relevant financial institution. You agree to your personal and financial information being transferred, stored, and processed by Plaid in accordance with the Plaid Privacy Policy found here https://plaid.com/privacy

Our Site, App, and Services are not intended for individuals under the age of 18. We do not knowingly collect personal information from such individuals.
Information we collect

We may collect the following categories of information in connection with your use of our Site, App, and Services, about you which are described in more detail below. All of the information listed is hereinafter referred to as "Information."

  • Registration Information: When you register for the Services, you will be asked for basic registration Information, such as an email address and password.

  • Identification Information: You may also be asked to provide identification Information upon registration, including, but not limited to, your first and last name, gender, income, marriage status, employment and date of birth.

  • Third-party credentials: You may also provide Recoup with certain credentials for third party services (“Third-Party Sites”) when you authorize us to connect to them on your behalf.

  • Information from Third-Party Sites: When you agree to have Recoup connect to any Third-Party Sites on your behalf, in order to provide you with personalized services, we will collect transaction-level data from the Third Party Sites via our Services. For example, if you register accounts such as, but not limited to, your email inbox, product or service provider, e-commerce website, checking account or credit card account with us, we will collect the transaction details from your checking account or credit card account in order to personalize our service.

  • Contests and surveys: From time to time, you may be offered an opportunity to participate in a contest, survey, or other promotion. We may collect or you may submit Information in connection with one of these promotions, including, but not limited to, information such as your first and last name, contact information and any other required information.
    Technical, device and navigational information: We may collect information about your interaction with our Site, App, or Services such as computer browser type, pages visited, average time spent on our Site, App, or Services, IP address, unique identifier of the device, device advertising identifier, operating system version and app version.

  • Location Information: If you choose to use a location enabled aspect of the Services, we may collect location Information from your device and will notify you of this collection. You may control or disable the sharing of location Information via your device setting and/or the Services.

  • Social network Information. You also may log in to the Services through your Facebook account. If you log in through your Facebook account, you will be asked to enter your Facebook login credentials and we will ask that you grant us permission to (i) access and collect your basic profile information, including your name, email address, and age, and (ii) access your friend list to identify other members. If you allow us to have access to this Information, then we will have access to this Information even if you have chosen not to make that Information public through your Facebook settings. Any third-party social networking site controls the information it collects from you. For information about how they may use and disclose your Information, including any Information you make public, please consult their respective privacy policies. We have no control over how any third-party site uses or discloses the personal Information it collects about you.

  • Career Information: You may provide Information when submitting your resume or applying for a specific job on our Site such as your career history and educational background.
    Additional Information as otherwise described to you at the point of collection or pursuant to your consent.
    How we use the Information we collect

We use and process your Information for things that may include, but are not limited to, the following:

  • issuing the promised services and rewards;

  • offering and improving the Site, App, and the Services, including creating and personalizing offers and rewards;

  • responding to your inquiries about our Site, App, and Services; analyzing usage of our Site, App and Services;

  • alerting you to software compatibility issues;
    delivering any administrative notices or alerts and communications relevant to your use of the Services;

  • for marketing and advertising purposes, including sending you promotional material or special offers on our behalf or on behalf of our marketing partners and/or their respective affiliates and subsidiaries and other third parties, provided that you have not already opted-out of receiving such communications;

  • to fulfill contracts we have with you;

  • offering you other products, programs, or services that we believe may be of interest;

  • performing market research, project planning, product development,

  • troubleshooting problems, and analysis of user behavior; to manage,

  • improve and foster relationships with third-party service providers, including vendors, suppliers, and parents, affiliates, subsidiaries, and business partners;

  • to help third-party services, including but not limited to, the merchants that you have registered with Recoup, improve their service;

  • conducting anonymized user analytics and industry benchmarking;

  • to comply with any applicable laws and regulations and respond to lawful requests;

  • for any other purposes disclosed to you at the time we collect your Information and/or pursuant to your consent;

  • enforcing our Terms of Services and as otherwise set forth in this Privacy Policy;

  • and a transaction in connection with a merger, sale, of substantially all of our assets, or a corporate reorganization.

  • Advertisers and Market Researchers. We may disclose aggregated, deidentified information to advertisers or market researchers about our Users interests or shopping patterns. We may also disclose information to third parties to serve advertisements regarding our products and services to users elsewhere on the web after they visit our website. This is a common practice called “retargeting.” We do not sell your Personal Information, as defined by applicable law.   • Business Partners or Clients. We may disclose deidentified, aggregated information regarding your use of our Services to help our business partners or clients better understand consumer behavior. For example, we may combine and/or aggregate receipt information or survey responses that you allow us to collect with the responses of others to produce deidentified reports. We may also create aggregated reports based upon deidentified modeled information. "Modeled information" is data based upon demographic and behavioral characteristics (e.g., gender, age, and purchasing habits) to predict what people with similar or matching characteristics would buy. We do not sell your Personal Information, as defined by applicable law.

  • Affiliate, Parent, and Subsidiary Organizations. We may disclose the information we collect from you to our corporate affiliates or subsidiaries; however, if we do so, their use and disclosure of your Personal Information will be subject to this Notice. In the event of a merger, sale of capital stock or assets, reorganization, consolidation, or similar transaction involving Company, the information we possess, including Personal Information, shall be transferred as a corporate asset to the acquiring entity.

  • Analytics Providers. We may disclose certain web logs, web beacons, or cookies you may have enabled on your computer or other device to third party analytics providers to assist us in analysis, auditing, research, and reporting regarding the Services. We use Google Analytics to help collect and analyze certain information for the purposes discussed in this Policy. You may opt out of the use of cookies by Google Analytics at https://tools.google.com/dlpage/gaoptout.

  • In order to allow you to use our Site, App, or Services, we may be required to verify your identity. To do so, we may, directly or through our service providers, use Information you provide and verify it against our service providers’ databases or through other sources. For instance, we may use the telephone number you provide to Recoup to verify your identity with telecommunications services providers. We may use your Information to verify your identity in the event you contact us for assistance with the Site, App, or Services. We may also use your Information to pre-fill form fields on the Services for your convenience.

When you use the App or mobile versions of our Site, we may collect the unique device identifier assigned to that device by phone makers, carriers, or makers of the operating system (the “Device ID”). Device IDs allow app developers, advertisers, and others to uniquely identify your device for purposes of storing application preferences and other data.
We may use your Device ID to contact you directly through push notifications. Additionally, we may use Device IDs to monitor suspicious activity. For example, if we detect that a single account on a Site or App is being accessed from multiple devices, as determined by tracking the Device IDs that access an account, we may contact the user to ensure that such access has been authorized by the user.

Information we process may be transferred to, stored, and processed in, the United States, Canada, or any other country in which Recoup or its affiliates, subsidiaries, or service providers maintain operations. By using and providing Information to us through the Site, App, and Services, you agree and consent to the transfer, storage, and processing of your information to any such country in order to provide the Site, App, and Services. Please be aware that Information, including personal data, that we collect may be transferred to, stored, and processed in a jurisdiction in which the privacy laws may not be as comprehensive as those in the country where you reside or are a citizen. We collect and transfer only Information, including personal data: with your consent; to perform a contract with you; or to fulfill a compelling legitimate interest of Recoup in a manner that does not outweigh your rights and freedoms. We endeavor to apply suitable safeguards to protect the privacy and security of your personal data and to use it only consistent with your relationship with us and the practices described in this Privacy Policy. We also enter into data processing agreements and model clauses with vendors whenever feasible and appropriate.

How we disclose the Information we collect

We may share your Information with our affiliates and subsidiaries for the purposes of providing the Services. In connection with the delivery to you of any Recoup services, we may share some of your Information with third parties in order to perform the services you have requested.

We may share your Information with our service providers to enable them to assist in fulfilling the requests you make or the actions you conduct via the Site and App, including the operation of certain Site and App functions and the Services.

We may share content you create on Recoup, including, but not limited to, product and service provider rating, review, written feedback, video feedback with third-party service providers. In turn, such service providers, may use share this content publicly on their website, social media channels, email newsletters, and any other channel we and they decide. In the event that this content is shared publicly, only your first name and last name initial (for example Jane D.) will be published.

Recoup and its service providers, may provide your Information in response to a search warrant or other legally valid inquiry or order, or to an investigative body in the case of a breach of an agreement or contravention of law, or as otherwise required or permitted by applicable Canadian, US or other law.

We may also disclose information where necessary for the establishment, exercise or defense of legal claims and to investigate or prevent actual or suspect loss or harm to persons or property.

We may transfer any Information we have about you as an asset in connection with a proposed or actual merger, sale, investment, or financing (including transfers made as part of insolvency or bankruptcy proceedings) involving all or part of Recoup or as part of a corporate reorganization or sale or other change in corporate control.

We may license, share or otherwise disclose information about users, content created by users, or users’ engagement with the Services with third parties for marketing, advertising, analytics, research or similar purposes. For example, we may provide participating merchants or third-parties with aggregated or anonymized information relating to users’ engagement with the Services to allow participating merchants and other third parties to assess the results of their campaigns.

We may disclose the information we collect from you and information that we collect about you (including the contents of your email messages) with your merchants, utility companies, billers, and financial institutions in order to provide our service. We never sell your data. For instance, we may email a merchant, on your behalf, from your Gmail, GSuite, Yahoo, MSN, Outlook or similar accounts, and disclose various data we collect from your email account in order to obtain a refund, credit, reward or another benefit for you. This includes, but is not limited to, your email address, billing history, name, date of birth, telephone number, and identity verification data you’ve established with that merchant. We may also share this information with third-party vendors, service providers, contractors or agents who perform functions on our behalf. However, we do not disclose any information we collect from your inbox with third parties unless it is related to your relationship, including billing history, with that third party. Recoup has executed appropriate contracts with its service providers that prohibit them from using or sharing your information except as necessary to perform the contracted services on our behalf. In certain cases, we may engage a Service Provider to de-identify parts of your Personal Information. If that Service Provider then makes separate use of that De-Identified Information, such use is not covered by this Privacy Policy.

A special note for Gmail and Yahoo users: For users of the Services who provide Recoup with access to their Gmail and/or Yahoo account, Recoup is subject to and complies with the “Limited Use” requirements set forth in the Additional Requirements https://developers.google.com/terms/api-services-user-data-policy#additional-requirements-for-specific-api-scopes for the Gmail Restricted Scope API and the “Data Use” requirements in the Yahoo Developer Policy https://developer.verizonmedia.com/mail/?guccounter=1 as of the Effective Date.

Any requested changes (adding connected email addresses or merchants, deleting connected email addresses or merchants, to your account may take 3-5 business days to be reflected.

WHEN YOU CREATE RATINGS OR REVIEWS OF TRANSACTIONS, PRODUCTS, RECEIPTS, SERVICES AND OTHER TRANSACTIONS WITHIN OUR APP, THE MERCHANT'S NAME, DOLLAR AMOUNT SPENT, DATE, AND LOCATION OF THE ITEM WILL BE POSTED WITHIN OUR APP AND IS SEARCHABLE BY OTHERS.

The privacy policies of the owners of third-party websites and apps may differ from our privacy policies. Please review the privacy policies and security indicators displayed on the external website before providing any personal information. Recoup neither endorses nor guarantees any of the information, recommendations, optional programs, products, or services advertised, offered by, or made available through the external website (“Products and Services”) and disclaim any liability for any failure of the Products and Services. It is your responsibility to manage and be informed about the information you share and Privacy Policies of non-Recoup Products and Services.

Description of usage of Gmail and Yahoo Mail API:

During a "claim period"¹, Recoup will manage the emails that are sent to a user from specific businesses after users authorize specific domains of businesses. User consent is required for each individual business (and associated domain(s)) that Recoup will monitor inbound and outbound emails from. Recoup will access the user's inbound and outbound emails through the Gmail API or Yahoo Mail API. Recoup may, through the Gmail API or Yahoo Mail API, reply to a business on the user’s behalf in order to obtain a refund, reward or credit for the user. Recoup may also organize and delete these emails. The user may opt out of Recoup's refund request process at any time. Recoup will monitor emails only during a claim period and for the businesses which the user has given explicit consent for Recoup to manage. Emails that are not from a specific business during a defined claim period will never be fetched, stored, or processed.
Definitions:

¹ Claim period: will begin after the user has given explicit consent for Recoup to manage inbound emails from a business, once Recoup sends the first outbound email to the business. The claim period will end on the sooner of:
4 days after a refund, reward or credit is obtained or Recoup determines that no refund, reward or credit will be given 30 days after the claim period began

How we protect the Information we collect

We take the security of your Information seriously. We use technical, physical and administrative safeguards, such as, but not limited to, firewalls, encryption techniques and authentication procedures to maintain the security of your Information. Unfortunately, no collection or transmission of information over the Internet or other publicly accessible communications networks can be guaranteed to be 100% secure, and therefore, we cannot warrant the security of any such information. We are not responsible for the circumvention of any privacy settings or security features. You agree that we will not have any liability for misuse, access, acquisition, deletion, or disclosure of your Information. Your online access may be protected with a password you select. We strongly recommend that you do not disclose your password to anyone. We will never ask you for your password in any unsolicited communication (such as letters, phone calls or email messages).

Third-party offers, advertisements, and data collection

We may offer a number of separate products and services offered by third parties advertised to you on our Site, App, and through the Services. These third-party offers may be complementary to your use of the Services and may be personalized based on Information you provide to us, Information we have collected about you, your transactions in your linked accounts, queries made through the Services, or other Information. If you choose to use these separate products and services, provide information to the third-party, or allow the third-party to otherwise collect Information about you, then their use of your Information is subject to the applicable third-party’s privacy policy and terms of service, not this policy. You should review the practices of the third-party before deciding to use their service or provide them with any Information.

As a user of our Site, App, and Services, you grant our service providers, including, but not limited to Plaid and Finicity, the right, power, and authority to access and transmit your data as reasonably necessary to provide the Services. In addition, you acknowledge and agree that your personal Information will be treated in accordance with the privacy policies of these service providers. You furthermore expressly grant our service providers the right, power and authority to (acting on your behalf) access and transmit your Information, including personal Information, as reasonably necessary to provide the Service to you and Recoup.

We may use third-party service providers to help us analyze certain online activities. For example, these service providers may help us measure the performance of our online promotions or analyze Services activity. We may permit these service providers to use cookies and similar technologies to perform these services. For example, we use a service provider such as Google Analytics on parts of the Site, App, or Services to determine interest and other data to better serve our customers. If you prefer to not have your data used by this service provider through our Site, you may visit the Google Analytics opt-out page.

How we use cookies and similar technologies

To help operate the Site, App, or Services, enhance you experience, and collect information about online activity, we may place small data files on your computer or other device. These data files may be in the form of cookies, pixel tags, local shared objects, or other similar technologies. Cookies and similar technologies enable us to personalize our Site and Services for you. These technologies allow us to store and manage your preferences and settings, measure and analyze how you use our Site and effectiveness of our communications, offer targeted products, programs and services, and help us improve our products, services, and security. Information collected includes internet protocol address, operating system, browser specifics of your device, device characteristics, user ID, and specifics regarding your interactions with (i.e., the path you take through) our Site and Services.

Most browsers provide you with the ability to block, delete, or disable these technologies. If you choose to reject cookies or similar technologies, some Services may not be available or some functionality may be limited or unavailable. Please review your browser manufacturer’s help pages for assistance with changing your settings. Clear GIFs are tiny graphics with a unique identifier, similar in function to cookies. In contrast to cookies, which are stored on your device’s hard drive, clear GIFs are embedded invisibly on Site or App pages. We may use clear GIFs (a.k.a. web beacons, web bugs or pixel tags), in connection with our Site and App to, among other things, track the activities of Site visitors and App users, help us manage content, and compile statistics about usage of our Site and App. We and our third-party service providers also use clear GIFs in HTML emails to our customers, to help us track email response rates, identify when our emails are viewed, and track whether our emails are forwarded.

We use third parties such as network advertisers to serve advertisements on third-party websites, apps, or other media (e.g., social networking platforms). This enables us and these third parties to target advertisements to you for products and services in which you might be interested. Third-party ad network providers, advertisers, sponsors and/or traffic measurement services may use cookies, JavaScript, web beacons (including clear GIFs), Flash LSOs and other tracking technologies to measure the effectiveness of their ads and to personalize advertising content to you (including addressable TV/b2b). These third-party cookies and other technologies are governed by each third party’s specific privacy policy, not this one. We may provide these third-party advertisers with Information, including personal Information, about you.
Users in the United States may opt out of many third-party ad networks. For example, you may go to the Digital Advertising Alliance (“DAA”) Consumer Choice Page for information about opting out of interest-based advertising and their choices regarding having information used by DAA companies. You may also go to the Network Advertising Initiative (“NAI”) Consumer Opt-Out Page for information about opting out of interest-based advertising and their choices regarding having Information used by NAI members.

Opting out from one or more companies listed on the DAA Consumer Choice Page or the NAI Consumer Opt-Out Page will opt you out from those companies’ delivery of interest-based content or ads to you, but it does not mean you will no longer receive any advertising through our Site or on other websites. You may continue to receive advertisements, for example, based on the particular website that you are viewing (i.e., contextually based ads). Also, if your browsers are configured to reject cookies when you opt out on the DAA or NAI websites, your opt out may not be effective. Our systems do not recognize browser “do-not-track” requests. You may, however, disable certain tracking as discussed in this section (e.g., by disabling cookies); you also may opt-out of targeted advertising by following the instructions above.

Children’s Information

We do not knowingly attempt to solicit or receive information from children on the Services. If we become aware that a user is under 13 (or a higher age threshold where applicable) and has provided us with Information, we will take steps to comply with any applicable legal requirement to remove such Information. Contact us if you believe that we have mistakenly or unintentionally collected Information from a child under the age of thirteen (13).

Public Ratings and Reviews

When you rate a transaction, merchant, product, or service, your Rating, Name, Username, and Amount Spent will be publicly visible to other Recoup users, merchants, and partners unless you mark the rating private. When you create a written or video review all are public, by default, within Recoup’s app. All public ratings and reviews may also be publicly available on merchant channels such as, but not limited to, websites, newsletters, social media, blogs. When you publicly rate or review a transaction, you will also auto-follow that merchant, product, or service's page within Recoup. Followers of a merchant, product, or service are visible to other users.

When you delete your Recoup account, any public ratings, written reviews, and video reviews will remain on merchant, social media, and other channels such as, but not limited to, websites, newsletters, others' social media, blogs. Recoup does not have the ability or responsibility to delete your content from the world wide web once downloaded, embedded, screen recorded, or otherwise shared by third parties off Recoup's website and apps.

Changes to this Privacy Policy

We reserve the right, at our discretion, to make changes to this Privacy Policy from time to time, so please review it frequently. You may review our Terms of Services and Privacy Policy at any time via links on https://www.recoup.com or from the App. Changes take effect immediately upon posting.
